BRASIL: É PRECISO LUTAR PARA DERRUBAR O PROJETO DE LEI QUE CRIMINALIZA AINDA MAIS O DIREITO AO ABORTO!

On Tuesday (11), the Chamber of Deputies, the bloc made up of congressmen from the traditional bourgeoisie and the far-right opposition with neo-fascist tendencies (supporters of former president Jair Bolsonaro) approved Bill 1904/24 on an urgent basis, which equates abortion after the 22nd week of pregnancy with the crime of murder. The urgency regime hastily approved by the president of the Chamber, Arthur Lira, means that it does not need to go through the discussions and analysis of the committees of the Federal Chamber, and can be brought to a vote directly in the plenary at any time.

The bill, authored by deputy Sóstenes Cavalcante of the Liberal Party (PL), not only bans abortion from 22 weeks of gestation in the situations currently provided for by law (in cases of rape, anencephaly or risk of death to the pregnant person), but also raises the prison sentence for women who carry out the procedure to 20 years in prison. To give you an idea of the aberration, the maximum prison sentence for anyone who commits rape is 10 years. In other words, the penalty for the rapist would be less than the penalty for the rape victim. For this reason, the population has already dubbed the bill the "Rapist's Bill".

The approval of the urgent procedure in the House of Representatives caused great national repercussions and immediate mobilization in the women's movements, and on the same night there were protests with thousands of people in some of the country's main cities, especially São Paulo and Rio de Janeiro. And more protests were planned for this weekend in defense of the life, dignity and freedom of pregnant women.

Just to give you an idea of the aberration of this bill, if it is approved, there will be a higher set of punishments for terminating a pregnancy in Brazil than in some countries and territories, such as Afghanistan, ruled by the Taliban, and Syria. In Syria, ruled by the totalitarian regime of Bashar Al-Asad and in civil war since 2011, the penalty is even lower: between 6 months and 3 years in prison for women who have an abortion outside the law, according to a report by the UN Human Rights office based on the Penal Code.

This bill, drawn up by a group of Bolsonaristas parliamentarians who adhere to evangelical Christian fundamentalism, is part of an attempt to gradually transform the country into a Christian theocratic regime, modeled on the Middle Ages. This bill is a huge step backwards for women's sexual and reproductive rights and is being processed at a time when the country is recording one of its highest rates of rape in general, including rape of the vulnerable, such as children and adolescents. In 2022, no less than 74,930 girls and women were victims of sexual violence, with 6 out of every 10 victims being under 13 years old, with the aggressors in most cases being family members and acquaintances.

The reality is that rape victims' access to specialized abortion services authorized by law is extremely difficult, especially for the poorest and those who live in the most inland regions, who end up accessing the service (when they manage to get there) at more advanced stages of pregnancy. The measure will therefore lead to these women and girls being victimized twice: (1) by the crime they have suffered and (2) by being denied their right to abortion because they are unable to access legal abortion services in time to have the procedure carried out before 22 weeks of pregnancy.

It took President Lula, who was traveling in Europe, exactly one week to make a statement, saying he was against abortion, but condemning the content of the bill for benefiting rapists. The president doesn't realize that regardless of his conciliatory stance towards fundamentalist religious conservatism, he definitely doesn't have the support of the majority of this reactionary sector of society and that further attempts to approve absurd bills will continue.

We as the Revolutionary Communist Current reaffirm our position in defense of the free right to abortion. We understand that this is a collective struggle, not just for women as a whole, but for society as a whole. We cannot accept this enormous attack and neither can we remain passive. We urgently need to organize the struggle and resistance to prevent this bill from being voted through!

Nesta terça-feira (11), a Câmara de Deputados, o bloco formado por congressistas da burguesia tradicional e da oposição bolsonarista de extrema direita com tendências neo-fascistas aprovaram em regime de urgência o Projeto de Lei 1904/24, que equipara a realização de aborto após a 22ª semana de gestação ao crime de homicídio. O regime de urgência aprovado apressadamente pelo presidente da câmara, Arthur Lira, significa que não precisa passar pelas discussões e análises das comissões da Câmara Federal, podendo ser levado à votação diretamente no Plenário, a qualquer momento.

O projeto, que é de autoria do deputado bolsonarista Sóstenes Cavalcante do Partido Liberal-PL, além de proibir o aborto a partir de 22 semanas de gestação nas situações previstas atualmente por lei (Em casos de estupros, anencefalia ou risco de morte para a pessoa gestante), ainda eleva a pena de prisão para a mulher que realizar o procedimento para 20 anos de prisão. Para se ter uma ideia da aberração, a pena máxima de prisão para quem cometer estupro é de 10 anos. Ou seja, a pena para o estuprador seria menor do que a pena para a vítima do estupro. Por isso, a população já denominou tal projeto de “Projeto do Estuprador”.

A aprovação do regime de urgência na Câmara causou grande repercussão nacional e mobilização imediata nos movimentos em defesa das mulheres, e na mesma noite aconteceram manifestações de protesto com milhares de pessoas em algumas das principais cidades do país, principalmente São Paulo e Rio de Janeiro. E estavam programados mais protestos nesse último fim de semana em defesa da vida, dignidade e liberdade das pessoas que gestam.

 Só para ter uma ideia da aberração desse projeto, se for aprovado, haverá um conjunto de punições mais altas para a interrupção da gravidez no Brasil do que a de alguns países e territórios, como por exemplo o Afeganistão, governado pelo Talibã, e à Síria. Na Síria, governada pelo regime totalitário de Bashar Al-Asad e em guerra civil desde 2011, a pena é ainda menor: entre 6 meses e 3 anos de prisão para mulheres que abortem fora da lei, de acordo com um relatório do escritório de Direitos Humanos da ONU com base no Código Penal.

Esse projeto, elaborado pelo grupo de parlamentares bolsonaristas adeptos fundamentalismo cristão evangélico, faz parte de uma tentativa para paulatinamente transformar o país num regime teocrático cristão, com modelo da Idade Média. Tal projeto de lei é um enorme retrocesso para os direitos sexuais e reprodutivos das mulheres e tramita num momento em que o país registra um dos seus maiores índices de estupros em geral, inclusive estupros de vulneráveis, como crianças e adolescentes. Em 2022, nada menos que 74.930 meninas e mulheres foram vítimas de violência sexual, sendo que 6 em cada 10 vítimas, tinham até 13 anos de idade, com os agressores na maioria dos casos sendo familiares e conhecidos.

A realidade é que o acesso das vítimas de estupro aos serviços especializados e autorizados por lei ao aborto são extremamente dificultados, principalmente aos mais pobres e as que moram nas regiões mais interioranas, que acabam tendo acesso ao serviço (quando conseguem chegar) já em estágios mais avançados de gestação. A medida, portanto, levará que essas mulheres e meninas sejam duplamente vitimizadas: (1) pelo crime que sofreram e (2) por terem seu direito ao aborto negado porque não conseguirem acessar os serviços de aborto legal a tempo de realizarem o procedimento antes das 22 semanas de gestação.

O presidente Lula, que estava em viagem pela Europa, demorou exatamente 1 semana para se pronunciar, afirmando ser contra o aborto, mas condenando o teor do projeto por beneficiar os estupradores. O presidente não se dá conta que independente de sua posição conciliadora com o conservadorismo religioso fundamentalista, ele definitivamente não tem o apoio da maioria desse setor reacionário da sociedade e que novas tentativas de aprovar projetos absurdos continuarão.

Entendemos que essa luta é coletiva.Essa luta não pode ser somente do conjunto das mulheres, mas de toda sociedade. Não podemos aceitar e tampouco ficar imobilizados diante desse enorme ataque. É preciso urgente organizar a luta e a resistência para impedir que a votação desse Projeto de Lei se concretize!
